THIS IS A CONTRACT. BY PLACING AN ORDER FOR PRODUCTS ON THIS SITE, YOU AGREE TO BE BOUND BY AND ACCEPT THESE TERMS AND CONDITIONS OF SALE. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS OF SALE, DO NOT PLACE ANY PRODUCT ORDERS ON THIS SITE.

BUYER'S REPRESENTATIONS. Orders by persons under age 18 are prohibited at this site and under this agreement. Medichest Products sold on this site are not intended for resale. Medichest cannot guarantee the suitability of the Products for use outside of the United States. International customers are solely and exclusively responsible for ALL costs associated with his/her order. These costs may include Duties, taxes, tariffs, unforeseen International Governmental expenses, etc. If you are an International Customer and your order is not delivered due to a dispute between your own local Governmental Rules and you, Medichest assumes no further liability once your order has left our facility. If your order is NOT delivered, you hereby waive any rights of reimbursement and you are solely responsible for full payment to Medichest. You hereby confirm to Medichest that you are at least 18 years of age.

ACCEPTANCE OF ORDER. Medichest's acceptance of your order is conditional on the availability of the Products and on approval of your credit at the time of shipment.

PAYMENT TERMS. Payment must be made using a valid Visa, MasterCard, Discover Card, American Express Card, Personal Check, or International Money Order. The credit card used for payment will not be charged until the Products are shipped. Charges will include the cost of shipping. If you select a shipping method that is not consistent with the appropriate delivery methods available by our carriers, you grant Medichest the full right and authority to charge your credit card additional costs associated with these shipping method modifications, with no limit to actual costs, and without any prior notice to you by Medichest.

Additional Shipping/Delivery Information and agreements:  Should an order be lost or damaged in shipping, we will open a claim with the shipper, upon your request. MediChest will replace or issue credit for the lost order or damaged item(s)  once the claim has been settled.  Our liability in cases of lost or damaged packages is limited ONLY and SOLELY to the amount of the claim paid and settled by the carrier. Time in transit for most Ground or Priority Mail packages is 2-7 business days. However, UPS Ground and Priority Mail are not guaranteed "on-time" services. 2nd Day Air, and 3 Day Select offered by UPS are guaranteed services and expected to arrive on the 2nd "business" day or the 3rd "business" day, respectively, once the order has been shipped. If the carton arrives later than the specified date provided to you by UPS, you may contact UPS at 1-800-PICK-UPS (742-5877) - Domestic Services 1-800-782-7892 - Intl. Export / Import Services and request a partial refund for your shipping. Medichest is not liable for delays in delivery or carton arrival. Once a package leaves our facility is is the responsibility of the "customer" to be in contact with UPS or The USPS, or other carrier to inquire as to the estimated delivery date and time of said order.

If a package cannot be delivered for any reason other than carrier loss or damage, to the address you provided, or should you refuse the package, you hereby agree to pay for the order in full and waive all rights of chargeback. Customer is responsible for additional charges associated with an invalid address.

OWNERSHIP OF THE PRODUCTS. The ownership of the Products shall transfer from Medichest to you upon shipment from Medichest's facilities. Any damages or assumed shortgages must be reported within 24 hours of recorded/tracked delivery by any carrier by contacting Medichest. (http://www.medichest.com/contactus.htm) or 203-854-0606.

WARRANTIES. Medichest’s warranties applicable to the Products are limited to the Manufacturers warranties only. Medichest assumes no liability for any products purchased by the BUYER for a period of forever and one day. The provisions of such warranties are included as part of these Terms and Conditions of Sale. The BUYER is solely responsible for contacting the MANUFACTURER for such warranty information. Images, descriptions, and actual product names are for illustrative purposes only and may not represent the most current manufacturer package. While all attempts have been made at accuracy, product packaging, colors, sizes, names, descriptions, and formulations are subject to change at the manufacturer's discretion without notice. MediChest assumes no responsibility for any of these changes, at anytime, and will not accept returns of any of the products sold on our website due to a change made by the manufacturer. Pseudoephedrine based products alert: A new federal law called “Combat Methamphetamine Epidemic Act of 2005” was approved by Congress in March, 2006 that places restrictions on purchases of products containing Pseudoephedrine. It is now a violation of that law to purchase more than 7.5 grams of Pseudoephedrine in a 30 day period through the mail. MediChest.com and its affiliates are required by federal regulations to report suspicious purchases to the Drug Enforcement Agency division of the United States Department of Justice. Attention: Pseudoephedrine orders that are being billed to one address and shipped to another will require an Adult Signature whereas the receiver/signer MUST be 21 years of age or older with proper I.D. presented at time of delivery. All Pseudoephedrine based orders being billed to one address and delivered to another will be billed an extra $6.75 for Adult Signature requirements at time of order shipment from our facilities.

LIMITATION OF LIABILITY. Medichest Shall Not Be Liable For Any Special, Incidental, Consequential, Indirect Or Similar Damages, Including Loss Of Profits, Damages To Your Property, Or Injury To You Or Others, Arising Out Of The Use, Misuse Or Inability To Use Any Product, Breach Of Warranty, Breach Of Contract, Or Negligence, Including, But Not Limited To, Medichest's Own Negligence, Even If Medichest Or Its Agent Has Been Advised Of The Possibility Of Such Damages, Or For Any Claim Brought Against You By Any Other Party, Including Any Claim That The Product Associated With The Product Infringes An Intellectual Property Right. Some States Do Not Allow The Exclusion Or Limitations Of Incidental Or Consequential Damages, So The Above Limitations Or Exclusions May Not Apply To You.

RETURN POLICY Return policies applicable to the Products are set out in the QUESTIONS section of this site (http://www.Medichest.com/questions.htm), and are included as a part of these Terms and Conditions of Sale. No exceptions to the Medichest Returns Policy shall be made. Violations of the Medichest Returns Policy shall be deemed as a violation of this Contract. If you REFUSE your order delivery, we will accept your refused carton and charge you a 40% re-stocking fee. We do not credit for shipping. If we are charged return shipping from UPS or The Postal Service, we will add these charges to your credit card as well.

GOVERNING LAW. These Terms and Conditions of Sale are governed by the laws of the State of Connecticut, excluding that body of law known as conflicts of law and the United Nations Convention on Contracts for the Sale of Goods.

ENTIRE AGREEMENT. These Terms and Conditions of Sale constitute the entire agreement between you and Medichest pertaining to the your purchase of Products from, or use of, this site and supersede in their entirety any and all written or oral agreements previously existing between us with respect to such purchase or use. You are responsible for ALL charges associated with this order and future orders if you AGREE to this contract. Chargebacks of any nature arising from a complaint lodged by the BUYER to his/her credit card bank shall be deemed as a violation of this contract. Where such chargebacks occur, the BUYER further agrees to indemnify Medichest and shall be fully responsible for any fees associated with said chargebacks. All chargeback fees shall be paid in full within 10 days notice to Medichest. Failure to pay Medichest the full amount due by these transactions shall constitute a violation of this contract and shall force the BUYER to incur any and all associated costs that secure Medichest’s unhampered payment of said charges. These charges include, but are not limited to legal costs, credit card fees, and bank charges. You further agree to allow Medichest to charge your credit card any and all costs associated with the collection of said costs.
